    Terms of Service

    Welcome to WriteWise. These Terms of Service ("Terms") govern your access to and use of WriteWise and its related services (the "Service").

    By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.


    1. Who we are

    WriteWise is operated by WriteWise Ltd, a New Zealand-based company. Our platform provides AI-powered writing feedback tools to students, primarily for educational use.


    2. Eligibility

    You must be at least 13 years old to use WriteWise.

    If you are under 16, we recommend that a parent or guardian reviews and approves your use of the Service.


    By using WriteWise, you confirm that:

  1. You are 13 years of age or older
  2. If under 16, you understand and accept the importance of guardian involvement
  3. You have the capacity to enter into a legally binding agreement (or your parent/guardian does on your behalf)

    4. 3. Your account

    You must provide accurate and complete information when registering for an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.


    You agree not to:

  4. Share your account with others
  5. Use another user's account without permission
  6. Attempt to bypass security or misuse the platform

    7. 4. Use of AI tools

    WriteWise uses AI services, including those provided by OpenAI, to generate feedback on your writing.

    By submitting content to WriteWise, you understand and agree that:

  7. Your text submissions may be processed by third-party AI providers to generate responses
  8. While we do not share your name or email with OpenAI, the content you submit may be processed and used by OpenAI in accordance with their own Services Agreement (Business Terms) (available at https://openai.com/policies/services-agreement)
  9. We do not permit OpenAI to use your content to train its models. Processing may occur outside Australia.
  10. You retain ownership of your submitted writing, but generated feedback may be derived from third-party systems
  11. Your use of the AI features is also subject to the OpenAI Services Agreement referenced above, which is incorporated into these Terms by reference

    12. 5. Acceptable use

    You agree not to use WriteWise to:

  12. Upload or generate content that is unlawful, threatening, harmful, or discriminatory
  13. Attempt to reverse engineer, decompile, or disrupt the platform
  14. Share content you do not have the right to upload
  15. Misrepresent your identity or affiliation

    16. We may suspend or terminate access if we believe you have breached these Terms.


    6. Data storage and location

    All data (including essays and personal information) is securely stored using services located in Australia, including Supabase (Sydney region) and Vercel.

    By using WriteWise, you consent to the storage and processing of your data in Australia.

    Some processing by our sub-processors may occur outside Australia (for example, OpenAI and certain Vercel services). Where personal information is disclosed overseas, we take reasonable steps to ensure comparable safeguards to the New Zealand Privacy Act 2020 (IPP 12).

    Your use of the Service in relation to data storage is also subject to the Supabase Terms of Service (available at https://supabase.com/terms), which are incorporated into these Terms by reference.

    7. Privacy and data handling (New Zealand Privacy Act 2020)

    What we collect:

  16. Name, email address, account metadata
  17. Essay content and learning activity
  18. Anonymised website usage analytics via Vercel Analytics (page views, referrer, browser type, device type, and country-level location). This data contains no personally identifiable information.

    19. Why we collect it (purposes):

  19. Verify identity and provide access to WriteWise and its AI-powered tools
  20. Operate, maintain, and improve the Service
  21. Respond to support and resolve issues
  22. Conduct anonymised research and analysis
  23. Comply with legal obligations and protect/enforce our rights

    24. Controller/processor roles:

  24. Direct sign-ups: WriteWise is the data controller for your personal information.
  25. School-managed accounts: If you signed up with your school, your school is the data controller and WriteWise acts as a data processor on the school’s instructions.

    26. Disclosures and sub-processors:

  26. Supabase (Sydney region), authentication and storage
  27. Vercel, hosting and privacy-first analytics
  28. OpenAI, AI-powered feedback
  29. Government agencies/regulators where required by New Zealand law, and any person you explicitly authorise

    30. Some processing may occur outside Australia (see section 6).


    Security and breach notification:

  30. We use encryption in transit and at rest, role-based access control, and least-privilege principles.
  31. If we become aware of a privacy breach that poses a risk of serious harm, we will notify affected individuals and (where required) the Office of the Privacy Commissioner as soon as practicable.

    32. Retention:

  32. Account/profile data while your account is active
  33. Essay content until you delete it or your account is closed
  34. Support emails and operational logs for up to 12 months (unless needed longer to resolve issues or meet legal obligations)

    35. We delete or anonymise personal information when it is no longer required.


    Access and correction:

  35. You have the right to access your readily retrievable personal information and to request corrections. Email leon@writewise.co.nz.
  36. We will respond within 20 working days (as required by the Privacy Act). If we decline a correction, we will note your request on the record. You may complain to the Office of the Privacy Commissioner (www.privacy.org.nz).

    37. Unique identifiers:

  37. We assign internal user IDs to operate the Service. We do not use unique identifiers issued by other agencies (e.g., NHI, NZQA) unless required and authorised by the school or by law.

    38. Cookies:

  38. We use strictly functional cookies for authentication and user interface preferences (e.g. keeping you signed in, remembering sidebar state). We do not use advertising, marketing, or third-party tracking cookies. You can disable cookies in your browser; some features (including sign-in) may not work correctly.

    39. Website analytics:

  39. We use Vercel Analytics to understand usage and improve performance. Vercel Analytics uses a privacy-first methodology: it does not use cookies, does not track users across sessions, and does not collect personally identifiable information (PII). IP addresses are anonymised at the edge and are not stored or retained. The anonymised data collected includes page views, referrer, browser type, device type, and country-level location.

    40. What we DON'T do:

  40. We do not use your information to send marketing messages or promotional material.
  41. We do not share your personal information with third parties for their own marketing.
  42. If you use WriteWise via a school, the school (as controller) may access student data to deliver the service and meet educational obligations. We disclose such data to the school only in accordance with our agreement with the school and applicable law.

    43. 8. Termination

    We may suspend or terminate your access to WriteWise if:

  43. You breach these Terms
  44. You use the service in a harmful or inappropriate way
  45. We are required to do so by law

    46. You may terminate your account at any time by contacting us at leon@writewise.co.nz.


    9. Intellectual property

    All rights to the WriteWise platform, software, and branding belong to WriteWise Ltd.

    You retain ownership of your original writing, but you grant us a non-exclusive licence to use your submissions to operate and improve the platform.


    10. Disclaimer and limitation of liability

    WriteWise is provided "as is" and "as available".

    We do not guarantee that:

  46. The platform will be free of bugs or interruptions
  47. The AI feedback will be error-free, complete, or appropriate for all situations

    48. To the fullest extent permitted by law:

  48. We are not liable for any loss or damage resulting from your use of the Service
  49. Our total liability is limited to the amount paid by you (if any) in the last 12 months

    50. 11. Changes to these terms

    We may update these Terms from time to time. If we do, we'll publish the updated version on our website.

    Continued use of the Service after changes means you accept the new Terms.


    12. Governing law

    These Terms are governed by the laws of New Zealand.

    Any disputes will be subject to the exclusive jurisdiction of New Zealand courts.
